MI Developments Marketing Contest Rules 1. (a) To enter visit www.racingfuture.com and click on Contest. Submit your idea as to how the horse racing industry can attract new fans and owners via email to RFmarketingidea@midevelopments.com. The Contest opens at 12:01 am on August 9, 2010. All entries must be received by 11:59 pm on September 15, 2010 (the “Contest Closing Date”) in order to be eligible to win the Contest Prize. 2. No purchase or expenditure or investment is necessary to enter the Contest. 3. FIVE (5) CONTEST PRIZES: The five Contest Prize Winners will receive the following prizes (the “Contest Prizes”): (a) one admission ticket (retail value $600) to the 2010 Advertising Age and Creativity Magazine IDEA Conference, to be held in New York City on October 28, 2010, and (b) the opportunity to pitch their idea to the Prize Sponsor for the chance to be awarded a marketing contract with respect to the racing properties owned by the Prize Sponsor, which pitch will take place within three months of the Contest Closing Date at a location and manner to be specified by the Prize Sponsor. Contest Prize Winners will be required to provide their own transportation and lodging. The Prize Sponsor does not guarantee that any of the Contest Prize Winners will be awarded a marketing contract. The Contest Prize Winners are solely responsible for any and all taxes and other legal disclosures associated with the Contest Prizes. Under no circumstances will the Prize Sponsor be obligated to award the value of the Contest Prizes in monetary payments. 5. Rulings of the Sponsors are final and without appeal in all matters relating to the promotion and awarding of the Contest Prizes. 6. Each selected entrant will be required to return a signed affidavit of eligibility, release and acknowledgement form to Prize Sponsor before being declared a Contest Prize Winner and awarded a Contest Prize. 7. By entering this Contest, each participant agrees that (i) if the participant is a winner of a Contest Prize, the Sponsors may contact that participant by e-mail, phone or postal mail; (ii) if the participant is the winner of a Contest Prize, to the use of his/her entry, name, address, idea and/or photograph in any publicity carried out by Sponsors and/or their advertising agencies, without further compensation, and to his/her photograph being taken by Sponsors for such use, without further compensation, except where prohibited by law; and (iii) participant releases Sponsors and each of their affiliates, subsidiaries, service agencies, and independent contractors and their respective directors, officers, employees, and agents, from any and all liability, loss or damage arising out of its participation in the Contest and with respect to the awarding, receipt, possession, use and/or misuse of the Contest Prize. All entries and ideas become the property of the Sponsors. 8. These are the official rules. This contest is subject to all applicable federal, state, provincial and local laws and regulations and is void where prohibited. These rules are subject to change without notice, to the extent permitted by law. The sole and exclusive venue for any legal action relating to or arising out of this contest shall be a court of competent jurisdiction located in California. 9. No correspondence will be entered into with any participant except with the selected entrant. To receive a copy of the rules go to www.adage.com or send a postage-paid self addressed envelope on or before the Contest Closing Date to Horse Racing Idea Contest, 455 Magna Drive, Aurora, Ontario, L4G 7A9. 10. Chances of winning depend on the number of entries. Sponsors are unaware of how many entrants there may be. 11. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Official Contest Rules may be disqualified by Contest Sponsor. Sponsors take no responsibility for lost, misdirected, late or destroyed entries, or for other errors. 12. Sponsors assume no responsibility for failure of the Contest website during the Contest period, for any problems or technical malfunction of any computer online systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including injury or damage to a participant’s or any other person’s computer related to or resulting from downloading any material in the promotion. Contest Sponsor reserves the right to suspend the Contest should a virus, bug or other cause beyond the reasonable control of Contest Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or email address or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Sponsors reserve the right to seek remedies and damages to the fullest extent of the law, including criminal prosecution. Contest Sponsor reserve the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be tampering with the entry process, whether on-line or by any other means, to have engaged in any fraud, or to be acting in violation of these rules. 14. This Contest is being run in accordance with these rules, subject to amendment by Contest Sponsor as permitted by law. Participants must comply with these Official Contest Rules and will be deemed to have received and understood these rules if they participate in this Contest.
